Rental Conditions and Houserules Casa da Palmeira – Lagos – Algarve – Portugal
These Rental Conditions and Houserules form an integral part of our “Confirmation Rental Contract Casa da Palmeira”. Deviations and exceptions are only valid if explicitly written and approved by both parties.
This rental contract is agreed for the period named. Renter has no rights or access to any apartment outside this period. In principle the minimum rental period is 7 days. The owner or his representative will give the key and instructions on arrival.
Renter can go into the apartment on the day of arrival after 14.30 hours and must leave the apartment on the day of departure before 10.30 hours. (Exceptions can be made in mutual agreement). Please inform the owner on your presumable time of arival at the apartment, in order to deliver the key and instructions. In this paper you find telephone numbers, email adresses and postadres.
It is not permitted to stay in the apartment with more persons, then agreed in the Rental Contract. The owner can refuse extra persons or charge extra money to be paid immediately.
After receiving and signing the Rental Contract a down payment of 30% has to be payed within 10 working days. Receipt of this amount is the definite confirmation of the booking. Furthermore it is needed that the Rental Contract is to be sended to the owner within 10 days. This can be done by email, fax (please give us a call just before you send a fax, as to astablish our computerr in faxmode) or by regular post.
The owner has to receive the total rental price AND the caution money of €.75,= on his bankaccount at least 6 weeks before the rental period starts. When no damage is done, nothing is broken or missing and everything is in order when leaving the appartment , renter will receive this caution money back on his bankaccount within 4 weeks after departure (please leave you IBAN bankaccountnumber !) In case of any damage, break or loss these costs will be deducted from the caution money.
If the term of payment is not accomplished the owner has the right to cancel the agreement. In this case no refunding or restitution is taking place.
In case of cancellation, for whatever reason, next costs will have to be paid:
- longer then 16 weeks before the rentalperiod starts ; restitution of the down payment
minus €.25,= administration costs.
- from 13 till 16 weeks before the rentalperiod starts; 30 % of the total rentprice (excluding cleaning/caution)
- from 8 till 13 weeks before the rentalperiod starts; 50 % of the total rentprice (excluding cleaning/caution)
- shorter than 8 weeks before the rental period starts; 100 % of the total rentprice (thus excluding the cleaning and caution money)
In case of early leave or not using the appartement renter has no right of any refunding or restitution what-so-ever.
Renter is liable for all damage, injury, missings, wastage or loss to the owners property, furniture, belongings and persons staying in Casa da Palmeira , unregarded if this is done deliberately or by accident or misfortune. All costs concerning this, have to be paid by renter immediately after happening.
Neither Casa da Palmeira, nor its owners are responsible in any way for any damage, loss or injury done to renters or guests or their belongings. The use of all facilities in and around Casa da Palmeira is strictly for everyones own risk ! The owner urges everyone to insure themselves and their luggage/belongings.
Neither Casa da Palmeira, nor its owners are responsible in any way for any damage, loss or injury caused by power cut, water-leakage, transport-delays (plane,bus, train etc.), government orders, natural disaster, terroristic action and such external factors. These are no reason for (partial) restitution or any subsidy.
Everyone in Casa da Palmeira is to be kept to our Houserules, concerning i.e. noise , alcohol- and smoking-conduct, the use of games, sports- and recreation-apparatus, swimmingpool, etc. For all transparency and actuality you will also find these rules in every apartment.
In this paper “renter”=“you”=“your”= all people staying in renters apartment, wether family, friends, guests,….
In this paper “owner”=“we”=“us”= Margareth and Erik Gommers from Casa da Palmeira, and everyone acting on behalf of them.
The most important houserules are :
A. No pets allowed in the apartments, exceptions only beforehand negotiable.
B. Smoking in the apartments is not allowed, outside is no problem, use ashtrays please ! If you really can’t do without a cigarette , please contact the owner.
C. Renter shall use and maintain the apartment and all facilities as a good housefather /-mother.
D. Renter shall leave the apartment clean and tidy.
E. If at arrival anything is missing, broken, damaged or not as it supposed to be, renter shall inform the owner at once. (If renter omits this notification, the owner can hold the renter responsible for these things and cover the costs through the caution money).
F. The swimmingpool and other extra facilities can be used between 09.00 and 23.00 hours.
G. Trampolines are to be used by one person at-a-time. Small children can jump with two together. Jumping is always at your own risk !
H. Darts is permitted for everyone above 10 years old.
I. Renter is requested not to bother or annoy other guests. If you are troubled by other guests, please contact the owner and he will look for a solution.
J. You and your children are requested not to make overwhelmingly noise, of course normal playing is not a problem at all.
K. Children will be under your responsibility at all times. Please make sure that your children clean up the toys they played with and to put it back in the right cupboards. That is the only way to keep things complete, tidy and ready for other guests.
L. Parking of your (rental-) car can be done on the street, but even better on the backside of the house. There is a square with a lot of parking places.
M. Please close all the gates, to prevent children to walk on the street unsupervised.
N. Excessive use of alcohol outside the apartment and near the extra facilities is not permitted.
O. Topless sunbathing and swimming is no problem to the owner, provided that other guests take no offence at it.
P. Diving in the swimmingpool is not allowed, because of the depth of the water (2,10 m max.), jumping is allowed. Playing and swimming is always at your own risk !
Q. You use gas out of bottles to heat the water and to cook on. Please notify the owner if the bottle is empty, so he will be able to renew the gasbottle immediately.
R. We urge everyone to use gas, water and electricity in an economic way for the sake of nature and environment. Thank you !
